ARRANGING POWER OF ATTORNEY

Outline of procedure for arranging Power of Attorney:

1. to have the power of attorney document witness by a local notary (see find a notary page - http://www.thenotariessociety.org.uk/) (cost approx £60-75)

2.the document has to be authenticated/legalised by the foreign and commonwealth office - http://www.fco.gov.uk/en/about-the-fco/what-we-do/docs-and-legal-services/legalisation/ - Cost £27 per document plus £6 for postage

3. legalisation by Cape Verde Embassy/Consulate. We have received the following from the Embassy in Brussels:

Regarding your questions we have the honour to inform the following:

a. By law, a document originating from outside to has effects in Cape Verde must be legalized by a Capeverdean Consulate/Embassy, through the recognition of the signature affixed to it (is this particularly case the Official of the FCO). Therefore, the correct procedure is that you recommend your clients.

b. The a cost for each legalization of a POA is 12 Euros, plus 7 Euros to send the doc back by mail;

- concerning payment you should make a bank transfer (we don’t accept cheques) to:

(lots of people including the Attorney's offices send their Euros in cash with the papers, but at their own risk...).

c. As soon as we confirm the transference/(or receive the money in cash…) we will delivery the procedure of legalization and send the POA back by mail, in the same day.

4. the document should then be sent to the representing lawyer.

Some lawyers take care of the procedure once the document has been notarised, others lawyers in Cape Verde expect clients to do this themselves. Note the document can also be sent to Joao Roberto the Cape Verde Honory Consul in Liverpool but his fee is £120. As you can see, the fee in Brussels is only €20.
